Utilitarianism, Economics and Legal Theory - Posner, Richard
Posner explores his proposition that utilitarianism and economics are NOT the same thing, and furthermore suggests that a concept he calls 'wealth maximization' provides a more solid grounding for a 'normative theory of law than utilitarianism'. Posner's piece is split into 2 parts with the first dealing with distinctions between positive and normative analysis, as well as criteria for selection of one over the other. Part II looks at the differences between the systems of utilitarianism and wealth maximization.
